The potential of the CBD industry has prompted many people to explore how they can launch a CBD business. The industry is not without its challenges, though, especially surrounding the evolving legal landscape, but the opportunity is significant.В

If you’re considering getting involved in the CBD industry, you first need to understand more about cannabinoids and the products that utilize them.В

What is CBD?

CBD is one of more than 100 cannabinoids, which are compounds found throughout the cannabis and hemp plants. The most famous cannabinoid is undoubtedly tetrahydrocannabinol (THC), which is responsible for the intoxication associated with the consumption of cannabis. CBD, however, does not produce an intoxicating effect; instead, it offers potential therapeutic and health benefits, though research into its potential medical applications is ongoing.В

CBD products are generally created in several steps. First, the raw material needs to be cultivated and harvested. For example, if you plan on using industrial hemp to create your CBD products, you will either need to cultivate or purchase a large amount of the plant. From there, CBD oil is extracted from the plant using a variety of methods. Again, you can do this yourself or outsource the process to an extraction company. Once you have extracted the CBD oil, it can be sold as a concentrate or used to infuse a variety of products. Some of the most common CBD products on the market today include sublingual tinctures, infused edibles and topicals, like gels or creams.

Hemp CBD vs. cannabis CBD

CBD is found in both cannabis and hemp plants. CBD oil can be extracted from either plant and used to create CBD oil products. However, there is a key difference between hemp CBD oil and CBD products derived from cannabis: THC.В

Industrial hemp contains less than 0.3% THC, and as such, it is considered legal under federal law to cultivate, harvest and process into finished products. Cannabis, on the other hand, contains more than 0.3% THC (often much higher levels) and remains federally illegal.В

Hemp and cannabis are closely related; in fact, industrial hemp is actually Cannabis sativa L. The difference in name is mostly a function of a legal definition, which sets the threshold for THC content. The flowers of a hemp plant contain little to no THC, while the flowers of a cannabis plant (commonly referred to as marijuana) contain much higher levels of THC.В

The federal government considers marijuana a Schedule I drug under the Controlled Substances Act, making it illegal for interstate commerce, even as dozens of states legalize it for adult use. Industrial hemp, on the other hand, was recently removed from the Controlled Substances Act altogether, opening the way for its cultivation and harvest in the U.S. for the first time since 1937.

Full-spectrum CBD vs. CBD isolate

If you’ve done any research into the CBD market already, you’ve likely encountered the terms “full-spectrum” or “isolate.” Depending on the extraction methods used, the CBD oil obtained from the plant might contain other cannabinoids and compounds found in the source plant. This is what is known as full-spectrum CBD. Full-spectrum CBD not only contains other cannabinoids found in the source material, but compounds known as terpenes, which are responsible for creating the flavor profile, aroma and specific effects of the plant.В

Understand your legal obligations

Just because the 2018 Farm Bill federally legalized industrial hemp and, by extension, hemp extract, like CBD oils, doesn’t mean there aren’t significant regulatory considerations surrounding the industrial hemp industry.В

The 2018 Farm Bill essentially removed CBD from the federal Controlled Substances Act and the oversight of the Drug Enforcement Agency. Instead, it placed governance of the hemp industry and CBD oil in the hands of the FDA.В

Currently, the FDA is still devising regulations, leaving the CBD industry in a sort of gray area. So far, the federal agency has signaled that marketing CBD as having health benefits will not be tolerated. It has also initiated a crackdown against CBD-infused foods and beverages in some instances.В

Further complicating the regulatory landscape is the 2017 approval of the CBD-based pharmaceutical Epidolex, an epilepsy medication that was approved by the FDA. Since CBD is a main ingredient in an FDA-approved drug, using it in food products without FDA approval could be illegal. Clearer guidance is sorely needed for CBD businesses to operate in compliance with federal regulations.В

“I think the FDA does have to step in, and they will,” said Slovik. “I expect a lot of changes to labels; we’re seeing a lot of businesses out there now using the term ‘hemp extract’ instead of CBD, or they’re not thinking of health benefits so much. Many companies are doing different things, but no one really knows [what the regulations will be] until it happens.”В

Understanding your legal obligations and playing it safe is key in a highly scrutinized industry. While CBD businesses everywhere await clearer regulatory guidance, it is important not to craft your marketing strategy around the supposed benefits of CBD. It’s also important to stay apprised of new developments as the FDA moves forward on crafting new regulations.

Market and sell your products

Marketing and selling CBD products is tricky. While the passage of the 2018 Farm Bill liberalized the industry a little bit (CVS and Walgreen’s now carry CBD products, for example), it is still difficult to sell CBD products on major online platforms like Amazon or eBay. Likewise, social media advertising is virtually nonexistent; paid ads for CBD products risk account suspensions or bans. All your growth must be driven through organic content that falls under the guidelines of each platform.В

“In today’s day and age, if someone is looking to sell a product, the normal avenues are Amazon, eBay, Alibaba or paid ads on social media,” Slovik said. “In this industry, it’s way, way, way different. You can’t do any of those things.”В

To successfully advertise and sell your CBD products, you will have to be creative. Establishing your own e-commerce store or carrying your products in a brick-and-mortar location is a must. Marketing your product with an organic search strategy and customer loyalty programs is always safer than engaging in paid advertising. And, of course, every market is a bit different, so do your research and understand your local and state laws.

How to gain a competitive advantage

The key to gaining a competitive advantage with staying power in the CBD industry is to develop a high-quality product that will withstand the coming scrutiny of both regulators and educated consumers. If you want to differentiate yourself from other CBD businesses, it’s key to provide third-party lab testing results to validate the quality of your product, Slovik said.

“We want to be more transparent by putting QR codes on all our bottles so anyone in the store can use their phone to get lab results right then and there,” Slovik said.В

In addition, Slovik said pursuing certifications like USDA organic, Good Manufacturing Practices and FDA facility registrations are important moves to instill confidence in consumers about the quality of the product they are buying.В

Overall, Slovik said, the formula for success is simple, even if the process is complicated.

“I would recommend double-, triple-checking everything. Know there will be changes. Research as much as you can, and recognize what the future opportunities are by thinking outside the box,” he said.

Key challenges facing CBD businesses

The CBD and cannabis industry faces unique challenges that other industries don’t. Most of these challenges relate to the regulatory environment and, as federal agencies like the FDA detail specific rules and guidelines, things should stabilize. For now, though, if you want to start a CBD business, you should be aware of these major considerations:В

  • Banking: Access to reliable banking services can be complicated due to the fluctuating regulatory landscape. Many banks are hesitant to do business with CBD and cannabis companies, fearing significant risk or burdensome oversight. Frequently, CBD businesses are forced to switch banks or experience the abrupt closure of a merchant account, which can seriously disrupt operations.В
  • Insurance: Finding affordable insurance for a CBD business is another major challenge. Prices remain elevated despite the legalization of industrial hemp, Slovik said, as the industry takes time to catch up to the developments. Education remains a key obstacle.В
  • Payment processing: Similarly, payment processors present high fees and other challenges to CBD businesses. Slovik said Visa recently cut off all CBD businesses, leaving him capable of only accepting MasterCard and Discover for payments.В
  • Access to capital: Banks and other lenders are reluctant to fund CBD companies, viewing the industry as too risky without clear regulatory requirements. So far, the CBD industry has relied on bootstrapping, outside investors or alternative lenders to find the growth capital it needs.В

Each of these challenges will likely be cleared up as more concrete regulation appears, but in the meantime, CBD businesses must remain adaptable and well-informed. Changes in the industry come on a day-to-day basis, so preparing backup plans ahead of time could save you a great deal of time and money should the worst come to pass.

This brand stocks quite a few products, and we simply couldn’t try them all. The website is really easy to use, breaking the products down into categories that are easy to navigate. Whatever you’re looking for, you’ll be able to find it with ease.

We tried out the Evolution CBD oil, gummies, and a handful of the amazing topical products. Below, we tell you what we thought of the product range, including whether our team found them to be effective.

Evolution CBD Oils

In total, Evolution CBD sells ten CBD oil options. The options include:

  • Water-soluble, full-spectrum CBD
  • Water-soluble, THC-free
  • Terpene-rich hemp oil
  • 3-in-1 CBD oil

With all these choices, you’re sure to find something that suits you. However, the range of strengths is fairly limited. Each product comes in a dropper bottle, providing complete ease of use.

As the brand’s flagship product, we obviously had to try the water-soluble CBD oils. These products are made using purified water rather than oil, so it’s barely a ‘CBD oil’ at all. Of course, the point is that they’re water-soluble, so this makes perfect sense.

If you’re wondering how Evolution CBD managed to infuse CBD into water, then look no further. The brand uses nanotechnology, reducing the particle size so that the cannabinoids blend seamlessly with water. Evolution CBD recommends using 1/2ml, equating to ½ dropper, per day.

There are two strengths available, including 50mg and 300mg. You also have the option to choose between zero THC and 0.3% THC in both strengths. Furthermore, Evolution offers five flavor options, including Cherry Limeade and Hemp.

Although Evolution uses nanotechnology, the pricing isn’t too bad, but remember that the strengths are low. The 50mg option costs $14.99.

Evolution CBD Gummies

Evolution CBD sells one CBD gummies product. The ingredients include glucose syrup, gelatin, and beeswax. The gelatin content means that these gummies aren’t vegan-friendly.

Evolution CBD’s gummies come in a 30-count tub, with 10mg of CBD per gummy. That’s 300mg per tub. The brand uses the same nanotechnology in its gummies, so the price is higher than other gummies on the market. However, if you believe the current research on nano-CBD, then they may also be more effective.

One tub of gummies costs $60. These aren’t the best gummies we have ever tried, especially since they contain artificial ingredients that many hemp brands try to avoid.

Evolution CBD Topicals

This brand has a large range of topicals, and we couldn’t try them all. The range includes:

  • Lip balm
  • Body lotion
  • Face cream
  • Topical cream
  • Bath bomb
  • Topical serum
  • Undereye serum

We decided to try the topical cream as it’s more comparable with other products on the market. It comes in two strengths: 250mg and 500mg. The cream comes in a tub that’s easy to get the cream out of.

Ingredients include aloe vera, vegetable glycerin, and vitamin A, D, and E. There are not many ingredients, nor are there any scents. The unscented cream is okay, but it’s pretty basic. As a result, we can’t give Evolution top marks for this topical.

The bath bomb is similar, with very little information about the ingredients. Each bomb contains 30mg of CBD and comes in three scents: Lavender/Lilac, Tea tree/Mint, and Oatmeal. Each bomb costs $14.99.

The creams, meanwhile, start at $59.99 for 250mg, which is pretty pricey.

Evolution CBD Review: Summary and Where to Buy

Evolution CBD undeniably has some good qualities, but it isn’t our favorite brand. Considering the product strengths, the prices are very high. Although, you do have to consider that you’re getting nano-CBD that may enhance the efficacy.

SB 282 made it so that both marijuana-derived and hemp-derived CBD products are completely legal for medicinal and recreational use with the condition that they contain 0% THC. When the 2018 Farm Bill became law, it redefined hemp as an agricultural commodity and removed CBD and hemp products from their former status as a Schedule 1 substance. While this step was a significant step toward cannabis legalization, the Farm Bill caused confusion at the state level, particularly for Kansas residents who had limited access to CBD products before the law was enacted.

Kansas has its own Industrial Hemp Pilot Program, which the Farm Bill helps support. Kansas consumers still can purchase CBD products but they must meet strict requirements while the Kansas Department of Agriculture (KDA) drafts additional rules for a regulated hemp industry.

What is CBD?

CBD is a cannabinoid found in cannabis and the second-most-abundant compound in the plant after THC. A non-intoxicating substance, CBD shows potential therapeutic benefits including anti-inflammatory, analgesic, anti-anxiety, and seizure-suppression properties. CBD can be derived from the hemp and marijuana plant.

Why is CBD sometimes illegal?

Even though industrial hemp doesn’t produce enough THC to intoxicate consumers, all varieties of cannabis, including hemp, were swept into the category of Schedule 1 under the 1970 Federal Controlled Substances Act. The law defined cannabis as a substance with no accepted medical use, a likelihood for addiction, and a high potential for abuse.

In 2018, Congress passed the Farm Bill and legalized hemp cultivation by removing it from Schedule 1. The Farm Bill defined hemp as cannabis that contains less than 0.3% THC by weight and marijuana as cannabis with more than 0.3% THC. Hemp-derived CBD was thus removed from its Schedule 1 designation, but CBD derived from the marijuana plant is still considered federally illegal because of marijuana’s federally illegal status. Hemp is considered an agricultural commodity, but still must be produced and sold under specific federal regulations, which were not finalized when hemp was legalized.

The Farm Bill also endowed the Food and Drug Administration (FDA) with the ability to regulate CBD’s labeling, therapeutic claims, and presence in foods or drinks. Despite the Farm Bill’s passage, the FDA has issued a directive that no CBD, even hemp-derived, may be added to food or beverages or marketed as a dietary supplement. The FDA has begun re-evaluating that stance on CBD products but has yet to revise rules or specifically regulate CBD products.

The FDA’s slow movement has created further confusion on the state level. The FDA has historically been strict when it comes to health claims or content that could be understood as medical advice — and makes no exception for CBD.

Hemp production and sale, including its cannabinoids and CBD specifically, remain tightly regulated federally. The Farm Bill provides that individual states may also regulate and even prohibit CBD cultivation and commerce. States may attempt to regulate CBD in food, beverage, dietary supplements, and cosmetic products independently of the FDA’s rules. Kansas has an existing industrial hemp pilot program and is in the early phases of drafting hemp regulations to be submitted to the USDA for approval.

Kansas CBD laws

In April 2018, Republican Gov. Jeff Colyer signed SB 263 into law, known as the Alternative Crop Research Act. This law came about in the wake of the 2014 Farm Bill, which allowed states to launch independent pilot programs to research the viability of hemp as a crop. The KDA launched the program in partnership with Kansas’ public universities to license farmers to grow hemp that contained no more than 0.3% THC. The KDA published regulations for the Industrial Hemp Research Program on February 8, 2019.

Shortly after SB 263 passed, Colyer also signed SB 282 on May 24, 2018, which amended the definition of marijuana to exempt CBD. The law broadly legalized Kansas CBD products, but the requirement that they contain zero THC has complicated access to CBD because most products contain at least trace amounts of THC.

On May 21, 2019, Democratic Gov. Laura Kelly signed SB 28 into law, also known as Claire and Lola’s Law, which prohibits child removal or child protection actions by providing an affirmative defense for parents or children who possess physician-recommended medical cannabis oil. The cannabis oil can contain no more than 5% THC and must have a lab test to prove its cannabinoid content. However, cannabis oil with any amount of THC cannot be purchased in Kansas, so patients currently have no access to cannabis for medical use.

After the passage of the 2018 Farm Bill, Kelly signed HB 2167 into law, which legalized the creation of a Kansas Industrial Hemp Program. To date, the only acceptable CBD products are those that have zero THC and all hemp cultivation must be licensed by the KDA.

Licensing requirements for CBD

The KDA oversees and licenses participants in the Industrial Hemp Pilot Program, including research distributors, growers, and processors. Applicants undergo comprehensive background checks to enroll in the program and must pay a non-refundable $200 application fee before their license is approved. Individuals convicted of felonies involving controlled substances are ineligible for participation.

The KDA is drafting regulations for the Kansas Industrial Hemp Program.

Testing requirements

All CBD products sold in Kansas must be labeled by the manufacturer and seller to include a list and description of all contents, statement of CBD purity, and a warning that the consumption of CBD could be hazardous to the user’s health.

Participants in the Industrial Hemp Research Program must pay $47 per hour for an initial sample collection, and a testing fee of $250 for each lab test. The test is to determine the THC content in the crop. If the sample contains more than 0.3% THC per weight, the plants in the growing area must be destroyed.

Sale regulations

There are no sale requirements for CBD that match Kansas’ legal definition of zero THC.

The conviction for sales of cannabis that contains any THC is a felony punished by tiers of fines and/or incarceration. The sale of fewer than 25 grams, or 0.88 ounces, can carry a sentence of up to 51 months in prison and a $300,000 fine. The sale of 25-449 grams, or 0.88 ounces to 1 pound, carries a sentence up to 83 months in prison and a $300,000 fine. The sale of 450 grams to 30 kilograms, or 1 to 66 pounds, is punishable by up to 12 years in prison and $500,000 in fines. The sale of any amount greater than 30 kilograms, or 66 pounds, can earn up to 17 years in prison and a fine of up to $500,000.

The sale of any amount of cannabis near a school can earn up to seven years in prison and a $300,000 fine.

Cultivation requirements

The cultivation of any hemp or cannabis is illegal outside of participation in the Kansas Industrial Hemp Program.

The cultivation of 4-50 plants is a felony, earning up to 83 months incarceration and up to $300,000 in fines. Anywhere 50-100 plants can earn up to 83 months in prison and a $300,000 fine, and any amount greater than 100 plants earns up to 204 months in prison and a $500,000 fine.

Kansas CBD possession limits

Kansas CBD laws permit citizens to purchase and possess CBD products that contain zero THC. CBD products can be sold as oils, powders, pills, and lotions. It is a crime to possess any amount of cannabis with trace amounts of THC beside CBD, though state legislators have relaxed possession penalties in recent years.

The possession of any amount of cannabis is a misdemeanor, punishable by either a fine of up to $1,000 and six months in jail. Subsequent offenses are felonies, punishable by up to 3 1/2 years in prison with potential fines up to $100,000. Possession with intent to distribute comes with more severe criminal penalties.

Where to buy CBD in Kansas

Kansas consumers can purchase CBD products at brick-and-mortar shops and through online retailers. Typically, Kansas citizens will find CBD products at specialty retailers and health and wellness grocers or pharmacies.

Kansas buyers also can purchase CBD products online, typically through a specific retailer’s website. However, some merchant processing companies consider CBD a restricted business and don’t support its sale. Confirm which checkout system a retailer uses before purchasing CBD online.

As they say, it’s all about the journey. South Carolina’s journey to CBD legalization consists of legislation and events that have sparked progress and even brought some roadblocks that need more time for development.

2014 – Julian’s Law/S1035/H4803

In 2014, Governor Nikki Haley signed Senate Bill 2015, also known as Julian’s Law. This bill allowed children with a certain debilitating medical condition to be treated with CBD oil if recommended by a physician. The legislation specified that the CBD oil must have a minimum of 98 percent CBD and a THC level of no more than 0.9 percent. It also stipulated that the CBD oil must be obtained from the Medical University of South Carolina.

Julian’s Law also opened up the opportunity for physicians to participate in a statewide medical study of CBD oil for other medical conditions.

2017 – Industrial Hemp Pilot Program/H3559

The state officially decided to heighten its crop diversity by legalizing industrial hemp cultivation in May 2017. In accordance with the 2014 Farm Bill, a pilot program was established to carry this out. This program authorized up to 20 growing permits for the first year and 40 for the second and third year. Each permit holder was allowed to grow up to 20 acres of industrial hemp for research purposes.

The number of permits granted in the years following would be determined by the Department of Agriculture and institutions of higher learning. It would be in the spring of 2018, where the state’s first 20 contingent cultivators would begin sowing hemp seeds. Interest in the program was strong, with 131 applicants during the first year.

2018 – Farm Bill & South Carolina’s Hemp Farming Act

The Farm Bill, signed by President Donald Trump in December 2018, removed hemp from the Controlled Substances Act (CSA), created wider access to growing licenses and allowed financial institutions to securely conduct business with hemp companies.

South Carolina jumped on board with this bill. Governor Henry D. McMaster signed the Hemp Farming Act, which lifted limits on hemp cultivation. It specifically:

Granted eligibility to anyone who previously applied for a grower permit under the previous pilot program to grow hemp in SC, provided they pass a background check.

Removed the cap on cultivated acreage.

Removed pilot program’s requirement that growers receive a letter of intent from an approved college or university.

The state permitted 113 growers to plant hemp across approximately 3,300 acres in 2019. And per the 2018 Farm Bill, as long as the THC content is under 0.3 percent, it is legal.

2019 – SC Regulators Set Boundaries on CBD

On February 20, 2019, the South Carolina Department of Agriculture (SCDA) made a statement that drew a line between what was legal and what wasn’t legal when it came to specific conditions around CBD. SCDA claimed CBD itself is legal but not when it’s added to “any human or animal food products for public sale,”

Derek Underwood, Assistant Commissioner of Consumer Protection, explained that until clinical studies can prove that CBD food items are safe and the FDA approves the research, they’ll remain illegal in the state. As a result, South Carolina CBD shops began halting their CBD food products, sticking to selling their non-food CBD products like tinctures.

Looking Ahead in South Carolina

With the legalization of hemp, SC legislators are now considering the possibilities of its sibling plant, marijuana. In September 2015, the Senate Medical Affairs subcommittee unanimously approved a bill that would create a medical marijuana program, but it did not pass.

The South Carolina Compassionate Care Act was proposed in 2018. If it’s signed into law, it would allow individuals with qualifying medical conditions to use medical marijuana. Specifically, it would provide this group with two ounces of marijuana, or an equivalent derivative, every two weeks. No final decisions have been made yet. It advanced to the SC House and Senate in 2019, but the legislative session concluded before the bill could be debated. The deadline to pass it has been pushed to 2020.
